Student Discrimination Grievance Investigative Process


Anytime the University receives a report that alleges that a student may be responsible for violating a University policy, the Office of Student Rights & Responsibilities (OSSR) will meet with involved parties and any witnesses to review the reported incident, including a University Conduct Hearing with the Respondent, and determine whether there was a violation of university policies. Depending on the nature of the reported incident and type of alleged policy violation, the Office of Student Rights & Responsibilities may utilize a specific set of procedures to best address the complaint. If the reported behavior potentially involves discrimination and/or was directed at a person due to a protected status, the Office of Student Rights & Responsibilities will utilize the procedures outlined in CWUR 3-45-010 Student Discrimination Complaint Procedures to investigate and resolve allegations of discrimination between members of the University community. Reported incidents involving alleged Sexual Misconduct policy violations of the Student Code of Conduct (WAC 106-125-020), that occur outside of Title IX Jurisdiction, as outlined in WAC 106-125-210, will be addressed using the Student Discrimination Complaint Procedures.

  • Student Conduct Process Advisor

    As an involved party in a potential Student Discrimination Grievance disciplinary process, you have the right to an advisor of choice throughout this process and may request a Student Conduct Process Advisor. A Student Conduct Process Advisor is a professional staff member within the Central Washington University community who has been trained to assist students as they navigate the disciplinary process.

  • Support Person

    Students may bring a support person to any meeting or hearing related to the Student Conduct Process, including but not limited to advocates, attorneys, friends, and family members. Support persons are not permitted to speak for, or on behalf of, the student during any meeting or hearing related to the Student Conduct Process.

    While your support person will have limited ability to participate in your University Conduct Hearing, they can attend the meeting with you to provide recommendations and/or support. With permission from the University Conduct Officer, your support person may make a statement and/or ask questions of the student to present relevant information after the conduct officer has completed discussions with the student.

    If you choose to do so, please fill out a Release of Information form ONLINE before your meeting.  You can do so by following the steps below:

    • Go to MyCWU
    • Go to their Student Dashboard by clicking “Student” in the top menu
    • In the left hand Menu click “Personal
    • When the menu opens, click “Release of Information” (Last option on the menu)
    • Then Release of Information window will pop up.  At the bottom click “Add Designee
    • Fill out the information
    • Enter designees first and last name
    • Create a 5-digit access code for the designee and share it only with that designee
    • Indicate what access you would like them to have (remember to check off “Disciplinary” for Student Rights & Responsibilities specifically)
    • Click Done to save the designee
  • Protective Measures

    During the investigation into the incident in question, both you and the other party may request interim protective measures or restrictions, including but not limited to: university no-contact order(s), assistance rescheduling classes, temporary work reassignments (as applicable), referrals for counseling, medical, or other relevant services. Similarly, applicable university personnel may also issue these or other protective measures as appropriate.

    When necessary, interim suspension measures may be enacted, consistent with the Student Conduct Code and/or employment policies and/or collective bargaining agreements.

  • Retaliation

    The university aims to protect all participants in these proceedings from retaliation. Retaliation means harming, threatening, intimidating, coercing, or taking adverse action of any kind against a person because such person reported an alleged violation, provided information about an alleged violation, or participated in any capacity in a university investigation.

    Retaliating against participants in these proceedings is serious misconduct and is subject to the full range of applicable sanctions.

  • False Complaints

    Filing a false complaint is considered to be serious misconduct and such offenses will be subject to the full range of applicable sanctions. A finding that a policy violation did not occur will not in itself be the basis for false or deceptive conduct.
