Sexual Misconduct

Title IX and Sexual Misconduct

Central Washington University (CWU) prohibits sexual misconduct. The university is committed to providing a learning, working, and living environment that promotes personal integrity, civility, and mutual respect; where no one is unlawfully excluded from participation in, denied the benefits of, or subjected to discrimination in any program or activity on the basis of sex, gender, sexual orientation, sexual identity, gender identity, or gender expression (“sex discrimination”).

CWU recognizes its responsibility to investigate, resolve, implement corrective and/or disciplinary measures, and monitor the educational environment and workplace to stop, remediate, and prevent discrimination on the basis of sex, as required by Title IX of the Educational Amendments of 1972, Title VII of the Civil Rights Act of 1964, the Violence Against Women Reauthorization Act, and Washington State’s Law Against Discrimination, and their implementing regulations. The university does not tolerate sexual misconduct in any form, including but not limited to acts of sexual violence, sexual and sex/gender-based harassment, domestic violence, intimate partner violence, and stalking.

CWU will investigate and pursue discipline based on alleged violations “sexual harassment” as defined in Title IX Grievance Procedure CWUR 3-45-061, as well as alleged violations of other federal, state, and local laws, their implementing regulations, and other University policies prohibiting gender discrimination through processes set forth in the University’s Student Conduct Code, employment contracts, and collective bargaining agreements.

The following types of student misconduct are prohibited:

• Sexual Misconduct (Sexual Harassment, Sexual Exploitation, and Sexual Violence) as defined in WAC-125-020 "Prohibited Student Conduct"

• Title IX Misconduct (i.e., Quid Pro Quo Sexual Harassment; Severe, Pervasive and Objectively Offensive Sexual Harassment; Sexual Assault; and Sex-Based Intimate Partner Violence and Stalking; as defined by and within the scope of Title IX) as defined in WAC 106-125-205 “Prohibited Conduct Under Title IX”

Office of Student Rights and Responsibilities Title IX Administrators
