CWUP 1-80-010 Appointing Authority

(1) Classified Staff Appointing Authorities

A resolution of the Board of Trustees of Central Washington University designating certain persons as "Appointing Authorities" for employment purposes and delegating the Board of Trustees´ powers and duties of employment under RCW 28B.35.120(2) to certain designated persons.

Whereas, effective May 6, 1971, and as still in effect, RCW 28B.10. 528 reads as follows:
The governing boards of institutions of higher education shall have power, when exercised by resolution, to delegate to the president or his designee, of their respective university or college, any of the powers and duties vested in or imposed upon such governing board by law. Delegated powers and duties may be exercised in the name of the respective governing boards.

And whereas, the Board of Trustees has determined that it is in the best interest of Central Washington University that the president of the university or designee has the power and duty to employ members of the classified staff under the provisions of the Washington Department of Personnel.

Now, be it therefore resolved, that under the provisions of RCW 28B.10.528 the Board of Trustees of Central Washington University designates that person now holding or subsequently appointed to the position of President of Central Washington University as "Appointing Authority" for the purposes of employment, discipline, or termination of any classified staff employee of Central Washington University and to delegate to that person now holding or subsequently appointed to the position of President of Central Washington University the powers and duties vested in and imposed upon the Board of Trustees of Central Washington University by the Legislature in RCW 28B.35.120(2), to employ individuals as members of the classified staff of the institution, who, except as otherwise provided by law, shall hold their positions until discharged there from by the President or designee for good and lawful reasons.

Be it further resolved, that under the provisions of RCW 28B.10.528 the Board of Trustees of Central Washington University designates those persons now holding or subsequently appointed to any of the presidentially designated positions set out below as "Appointing Authority" for purposes of employment, discipline, or termination of any classified staff employee under that person´s immediate supervision; and delegate to those persons now holding or subsequently appointed to any of the presidentially designated positions set out below the powers and duties vested in or imposed upon the Board of Trustees of Central Washington University by RCW 28B.35.120(2), to employ individuals as members of the classified staff of the institution in positions of employment under that person´s immediate supervision, who, except as otherwise provided by law, shall hold their positions until discharged there from by any of the persons now holding or subsequently appointed to any of the presidentially designated positions, set out below, of Appointing Authority, for good and lawful reasons and all actions taken pursuant to this resolution may be subject to the approval or disapproval of the President of Central Washington University.

It is further resolved, that the following list shall constitute the presidentially designated positions in which the designation as "Appointing Authority" and the delegations of powers and duties set forth in this resolution are made:

Be it further resolved, that all actions taken pursuant to this delegation of powers and duties may he exercised in the name of the Board of Trustees of Central Washington University.

(2) Faculty

A resolution of the Board of Trustees of Central Washington University delegating to the president and the president’s designees the power and duty to make changes in assignments of faculty and special (up to one year) appointments to the faculty; and to employ, discipline or terminate any faculty employee of Central Washington University.

Whereas, RCW 28B.35.120, provides:

"In addition to any other powers and duties prescribed by law, each board of trustees of the respective regional universities:

(2) Shall employ the president of the regional university, his assistants, members of the faculty, and other employees of the institution, who, except as otherwise provided by law, shall hold their positions, until discharged therefrom by the board for good and lawful reason": and

Whereas, RCW 28B.10.528 provides:

"The governing boards of institutions of higher education shall have power, when exercised by resolution, to delegate to the president or his designee, of their respective university or college, any of the powers and duties vested in or imposed upon such governing board by law. Delegated powers and duties may be exercised in the name of the respective governing boards."; and

Whereas, the Board of Trustees has determined that it is in the best interests of Central Washington University to confirm that the university president and the president’s designees have the power and the duty to appoint, discipline and terminate faculty and to make and to change the assignments of faculty, pursuant to the Academic Code or faculty union contract; and

Whereas, the Board of Trustees has determined that it is in the best interests of Central Washington University to confirm that the university president and the president’s designees have the power and duty to make special appointments to the faculty, limited to one year or less, as provided for in Section 4.60 subpart C of the Faculty Code of Personnel Policy; and

Now, therefore, be it resolved, that under the provisions of RCW 28B.10.528, the Board of Trustees hereby delegates to the university president, and to all others to whom the president sub-delegates in writing, the power and duty to change the assignments of faculty, pursuant to the Academic Code or faculty union contract, as now existing or hereafter amended; and

Be It Further Resolved, that under the provisions of RCW 28B.10.528, the Board of Trustees hereby delegates to the university president, and to all others to whom the president sub-delegates in writing, the power and duty to make appointments to the faculty, limited to one year or less, pursuant to the Academic Code or faculty union contract.

Be it further resolved that the Board of Trustees expressly retains its power and duty to make all other faculty appointments, including probationary appointments, appointments with tenure, full-time non-tenure-track appointments, part-time non-tenure-track appointments, and appointments to endowed chairs.

Be it further resolved, that each appointment to the faculty made by the president or the president’s designees pursuant to this delegation of powers and duties should be reported to the Board no later than its next regular meeting.

Be it further resolved, that all actions taken pursuant to this delegation of powers and duties may be exercised in the name of the Board of Trustees of Central Washington University.

(3) Administrative Civil Service Exempt Staff

A resolution of the Board of Trustees of Central Washington University delegating to the president and the president’s designees the power and duty to appoint, discipline and terminate exempt employees.

Whereas, RCW 28B.35.120 provides:
"In addition to any other powers and duties prescribed by law, each board of trustees of the respective regional universities:

(2) Shall employ the president of the regional university, his assistants, members of the faculty, and other employees of the institution, who, except as otherwise provided by law, shall hold their positions, until discharged therefrom by the board for good and lawful reason;” and

Whereas, RCW 28B.10.528 provides:

"The governing boards of institutions of higher education shall have power, when exercised by resolution, to delegate to the president or his designee, of their respective university or college, any of the powers and duties vested in or imposed upon such governing board by law. Delegated powers and duties may be exercised in the name of the respective governing boards;” and

Whereas, the board of trustees specifically delegates its authority by formal motion or resolution to the president or the president’s designee to authorize appointments, leaves, and other employment conditions and privileges contained in the exempt employee code; and

Whereas, the Board of Trustees has determined that it is in the best interests of Central Washington University that the president of the university and the president’s designees have the power and the duty to exempt employees, as defined in the exempt employee code, as now existing or hereafter amended;

Now therefore, be it resolved, that under the provisions of RCW 28B.10.528, the Board of Trustees of Central Washington University hereby delegates to the university president and to others to whom the president sub-delegates in writing, the power and duty to exempt employees, as defined in the exempt employee code, as now existing or hereafter amended.

Be it further resolved, that all actions taken pursuant to this delegation of powers and duties may be exercised in the name of the Board of Trustees of Central Washington University.

(4) Duties of Appointing Authorities

(A) Appointing Authorities: Current appointing authorities are listed in the appointing authorities resolution CWUP 1-80-010(1) – Classified Staff Appointing Authorities).

(B) Duties and Responsibilities of Appointing Authorities - Certain principal administrators, designated "appointing authorities," use delegated authority to employ and terminate faculty, administrative exempt and classified personnel in accordance with the laws and regulations governing employment and termination of those employees. The president of the university designates appointing authorities by position with official approval granted by the Board of Trustees. Actions of appointing authorities are subject to the approval or disapproval of the president.


Position control for all faculty, administrative exempt and classified positions will be maintained in the following manner: Appointing authorities cannot create, fill, reallocate, or eliminate positions under their direct control without written approval from their supervisor.

1. Ensure all personnel appointments and actions are made in accordance with applicable codes, union contracts and/or rules and regulations.

2. Establish, appoint, and approve in writing all search committee members for new or vacated positions. Provide written criteria for the operation and duties of the search committee.

3. Approve all personnel action forms for full-time, part-time, adjunct, and temporary (other than student) employees in their respective area of responsibility. This responsibility cannot be delegated to any other person in the area of responsibility.

4. Initiate a personnel action form (PAF) for all employees (full-time, part-time, adjunct, and temporary [other than students]) on any change in work assignment or pay status. All employees given assignments under different appointing authorities must have their personnel action forms signed by each appointing authority.

5. May delegate in writing student employment appointing authority to department chairs, directors, and program managers. Written delegation will be forwarded to Human Resources and Student Employment for those delegated student employment authority.

6. Execute and sign all employment contract letters for faculty, administrative exempt and classified personnel. Make no verbal commitments in the employment of personnel. All conditions for employment must be stated in the employment letter or contract. This responsibility cannot be delegated to any person in the area of responsibility. (Human Resources will prepare the employment offer letter on classified and exempt personnel for signature by the appointing authority and the offer letter for faculty).

7. Use only the recommended employment contract format provided by Human Resources for the employment of administrative exempt and classified employees and for faculty. If exceptions to the standard format are needed, consult with the appropriate vice president or chief of staff and secure written approval to include the exception as an addendum.

8. Assure all subsequent changes to the employment contract and/or appointment letter are authorized and in accordance with applicable codes and/or rules and regulations.

9. Assure all absences from work are authorized and in accordance with applicable codes, union contracts and/or rules and regulations.

10. Certify that an appointment complies with the university's family employment policy and the state ethics law.

11. Use a full signature on all contracts and letters.

12. Review and maintain updated job descriptions for all exempt and classified staff in the area of responsibility.

13. Perform or request yearly evaluations of all administrative exempt and classified staff in the area of responsibility in accordance with established criteria, job descriptions, and performance of duties.

14. Ensure copies of all personnel documents are forwarded to Human Resources for placement in the employee's permanent file.

15. Ensure all personnel actions (e.g., hires, promotions, transfers, etc.) are carried out in a nondiscriminatory manner and comply with university procedures.

16. Keep abreast of affirmative action responsibilities and employment goals for unit(s) supervised. (See CWU Affirmative Action Plan.) Communicate commitment to affirmative action and equal opportunity to managers/department chairs and staff through actions as well as words.

17. Uphold and promote university nondiscrimination policies. Attend university-sponsored training programs on such topics as the Americans with Disabilities Act and sexual harassment, and encourage participation of managers/department chairs in similar endeavors.


18. Respond to complaints of illegal discrimination in a timely fashion, consulting with the appropriate university officials as needed.

19. Keep abreast of the rules and regulations governing all employees in the area of responsibility.

The signature/authorization of an appointing authority on an employment document or personnel action form certifies to the best of their knowledge the appointment/action is taken in accordance with all applicable codes, union contracts and/or rules and regulations and that the signer understands the duties and responsibilities of an appointing authority.

The university's Human Resources and Payroll offices will require appointing authorities to strictly adhere to these duties and responsibilities.

CWUP 1-80-020 Contracting Authority

A resolution of the Board of Trustees of Central Washington University delegating their powers and duties for contracting as defined by RCW 28B.35.120, subsections (6), (7), (9), and (11) to certain designated persons.

Be it therefore resolved, that under the provisions of RCW 28B.10.528, the Board of Trustees of Central Washington University designates that the person now holding or subsequently appointed to the position of President of Central Washington University as the authority for contracting for current operations of Central Washington University when such contracting is in accordance with budgets approved by the Board of Trustees and delegates to that person now holding or subsequently appointed to the position of President of Central Washington University, subject to such direction as the Board may from time to time provide, the authority to so exercise the powers and duties vested in or imposed upon the Board of Trustees by the Legislature in RCW 28B.35.120, Subsections (6), (7), (9), and (11); and

Be it further resolved, that under the provisions of RCW 28B.10.528, the Board of Trustees of Central Washington University designates those persons now holding or subsequently appointed to any of the presidentially designated positions set out below as authorities for contracting for current operation of Central Washington University when such contracting is in accordance with budgets approved by the Board of Trustees, and delegates to those persons now holding or subsequently appointed to any of the presidentially designated positions set out below the powers and duties vested in or imposed upon the Board of Trustees of Central Washington University by RCW 28B.35.120, subsections (6), (7), (9), and (11) to so contract, purchase and lease, and all actions taken pursuant to this resolution may be subject to the approval or disapproval of the President of Central Washington University.

Associate Vice President, Enrollment Management and Organizational Effectiveness – All contracts as may be required for delivery of student services or for the operation of the Enrollment Management and Organizational Effectiveness Units.

Associate Provost – All contracts as may be required to enhance and assess academic programs, the operation of the associate provost unit or services required to fulfilling responsibilities on behalf of the Provost

Director, Organizational Effectiveness – Limited to contracting for personnel and other services required for organizational effectiveness and research.

Director, Parking and Police Services – Limited to contracting for personnel and other services required for public safety.

Assistant Vice President, Facilities Management – Limited to contracting between Central Washington University and contractors for the completion of capital projects as specifically approved by the State Legislature and the University Board of Trustees. This authority extends to contracts, change orders and field authorizations up to a limit of $200,000 per transaction. The Assistant Vice President of Facilities Management may, with the written concurrence of the Vice President for Business and Financial Affairs/Chief Financial Officer, delegate contracting authority at a lower level to licensed architects and engineers who are Project Managers on individual construction projects, and to the two senior managers in charge of building maintenance and custodial/landscape maintenance. Such delegation shall not exceed $75,000. Authority for the actual disbursement of funds after the completion of work will require the signatures of the Project Manager and a higher-level supervisor.

Assistant Vice President, Information Technology– Limited to contracting for computing and voice/data equipment, software, and supportive services in accordance with the policies, procedures, and Washington Administrative Codes established by the State Information Services Board pursuant to Chapter 43.105 RCW.

Chief Human Resource Officer – All contracts as may be required to enhance and assess staff and faculty programs and development. Other contracts limited to contracting for personnel and other services required to fulfill the responsibilities in human resources.

Dean, Graduate Studies and Research – Authorized representative for all contracts as may be required for delivery of research, economic development and graduate studies or for the operation of the unit.

Dean, Library Services – Limited to purchasing and contracting for the acquisition of collections including books, films, prerecorded audio and video tapes, library subscriptions and periodicals (print, electronic, and other formats), database and bibliographic utility services, bibliographic records, and delivery of services to students.

Assistant Vice President, International Studies and Programs – Limited to contracting personnel and other services required to conduct Central Washington University international programs.

Associate Dean, University Housing and Student Living – All contracts as may be required for delivery of student services or for the operation of the University Housing and Student Living Unit.

Associate Dean, Student Achievement – All contracts as may be required for delivery of student services or for the operation of the Student Achievement unit.

Associate Dean, Student Life – All contracts as may be required for delivery of student services or for the operation of the Student Life unit.

Director, Conference Services – Limited to contracting for personnel and other services required to conduct the Central Washington University Conference Program.

Director, Athletics – Limited to contracting with other colleges and universities for “Athletic Contest Agreements” when such do not require expenditure of Central Washington University funds, and to contracting for officiating services requiring expenditure of funds in amounts not to exceed $500.00 per contract.

Director, Continuing Education – Limited to contracting for personnel and other services required to conduct the Central Washington University Continuing Education and Summer Session Programs

Director, Wildcat Shop – Limited to purchasing and contracting for items for resale through the Wildcat Shop.

Chair, Department of Music – Limited to contracting for the rental of performance music to be used by departmental ensembles and chamber groups and for agreements related to the loan of musical instruments for departmental use. These performance music rental and instrumental loan agreements may not exceed $500 for any one contract.

Director, Campus Life and Student Facility Development – Limited to contracting for entertainment activities for the Student Union and the Associated Students of Central.
Associate Director, Campus Life – Limited to contracting for entertainment activities for Campus Life.

Assistant Vice President, University Centers – Limited to contracting for the CT3 contract forms and other contract forms associated with Worker Retraining and Workforce initiatives, as part of the Master Washington State Employment Security Department Agreement.

Secretary to the Board – All contracts, deeds, leases, notes, mortgages, deeds of trust, bonds, indentures, warrants, undertakings, powers of attorney, releases and satisfactions of mortgages and indebtedness’s, reconveyances under deeds of trust, and all other releases, when the same have been authorized to be executed by order of the board of trustees and for all meeting arrangements (food, lodging, meeting space) for the board of trustees.

OTHER SIGNATURE AUTHORITIES:

For contracts for services only (does not include contracting for purchase goods) in amounts less than $25,000, and which are written within the respective appropriate areas as designated below. Also delegated to the specified positions are authorities to ratify “after-the-fact” purchase requisitions for both goods and services when such ratification is found by the Principal Budget Administrator to be in the best interest of Central Washington University, and when ratification will not violate Washington State Purchasing Law by circumventing competitive bidding requirements, the receipt of competitive quotations, or the Minority and Women’s Business Enterprises purchasing law: Chapter 39.19 RCW and Chapter 326 WAC.

CWUP 1-80-030 Delegation of Authority to the President

A resolution of the Board of Trustees of Central Washington University delegating certain administrative powers and duties to the president of the university.

Whereas, pursuant to RCW 28B.35.120 (1) and (12), the Board of Trustees is vested with “full control of the university, except as provided by law” and “may promulgate such rules and regulations, and perform all other acts not forbidden by law, as the board of trustees may in its discretion deem necessary or appropriate to the administration of the regional university“; and

Whereas, the Board of Trustees is authorized pursuant to RCW 28B.10.528 to delegate to the President of the University any of the powers and duties vested in or imposed upon the Board of Trustees; and

Whereas, the Board of Trustees has developed a relationship of trust in the President’s ability to administer the University and to promulgate policies that ensure compliance with legal, ethical, and regional accreditation standards and that strengthen the institution.

Be it resolved, that the Board of Trustees of Central Washington University, as follows:


1. The Board delegates to the President, subject to the limitations set forth below, the authority to promulgate such rules and regulations as the President deems necessary or appropriate for the administration of Central Washington University.

2. The Board expects the President to inform the Board of new and substantively modified rules, regulations and policies enacted under the provisions of this resolution on a periodic basis.

3. Be it further resolved, that nothing in this resolution is intended to delegate the authority of the Board of Trustees to approve certain actions of the University as expressly specified in CWUP 1-10-060 Relationship to Other University Bodies.

4. All actions taken pursuant to this delegation of administrative powers and duties may be exercised in the name of the Board of Trustees of Central Washington University.

5. The delegation of authority for administration of the University provided forin this resolution may be revoked in whole or in part through subsequent action of the Board at any time.
